Sierra Club Asks EPA To Review Post Storm Permit Waivers
November 13 2012 -The State of New Jersey has moved forward with waivers of certain permitting requirements to help government agencies repair or replace roads, bridges, bulkheads and other critical infrastructure damaged by Hurricane Sandy. However, the Sierra Club has called upon the U.S. Environmental Protection Agency to intervene and oversee such waivers too ensure there are no violations of federal environmental laws and regulations.
The conditional waiver covers the in-kind replacement and repair of legally existing public infrastructure affected by the storm, according to the administrative order. That infrastructure includes not only roads and bridges, but also railroads, culverts, utility lines, outfall structures, stormwater management basins and shoreline stabilization structures.
The permit requirements being waived include those under the state's Flood Hazard Area Control Act rules, the Coastal Permit Program rules and the Freshwater Wetlands Protection Act rules, according to the order. The DEP will provide retroactive approval for public infrastructure projects based on documentation of storm damage, which cities and towns in the state will have six months to provide.
